Terms
The agreement behind every order.
Version 1
1. Who you buy from
A Tale Called You is a sole trader based in Belgium. Email: [email protected]. For product-safety purposes, we are the manufacturer of every piece sold under this name.
2. What you buy
A made-to-order artwork of your child, created from the photo, first name, age and gender you provide. It comes as an unframed print on museum cotton paper, or framed in real wood behind shatterproof acrylic, in the size and finish you configure. You must be 18 or older to place an order.
3. Your photograph
By sharing a photo you confirm three things: you are the child’s parent or legal guardian, or you have the parent’s permission; you have the right to use the photo; and the photo shows the child your order is for. You keep all rights in your photo. You give us permission to use it for one purpose only — making your order — and that permission ends when we delete the file. How we protect and delete it is in the privacy policy. If you believe a photo on our shop infringes your copyright, write to [email protected] and we act on it.
4. Order, preview, approval
Your order becomes a contract when you pay. Then we make the artwork and email you a preview. Nothing prints before you approve the preview. If your photo does not work, we ask for another. If we cannot deliver what you ordered, we tell you and refund you in full. If you do not respond to the preview, we send reminders — and you can cancel for a full refund the whole time, because nothing has printed.
5. Prices and payment
The exact price for your configuration is shown before you pay, in your currency, with VAT and shipping included. There are no further charges for EU and US delivery. Payment is taken at checkout by Stripe. We never store your card details. You receive your order confirmation and these terms by email, so you can keep them.
6. Cancellation and the right of withdrawal
Before you approve the preview, you can cancel at any time for a full refund — write to us with your order reference. This is a right we give you in this contract, and it exists because nothing is printed before your approval.
After you approve, the piece is printed for one child, made to your specification. Under EU consumer law, personalised goods like this are excluded from the 14-day right of withdrawal that applies to off-the-shelf products (Article 16(c) of the Consumer Rights Directive; Article VI.53, 3° of the Belgian Code of Economic Law). This means you cannot return the piece for a change of mind once it prints. You see and approve exactly what will print.
7. Digital gift cards
A gift card buys one piece — the format and size named on the card — for a child the recipient chooses later. The card is delivered by email, to the recipient or to you, on the date you pick. It can be redeemed for three years from purchase, in the shop region it was bought in, and its value is the piece itself: if the price of that format changes, the card still covers it in full. A card is redeemed once, is not exchangeable for cash, and any redemption order follows these same terms, preview and approval included.
A gift card is not a personalised good, so the 14-day right of withdrawal applies to its purchase: for 14 days after buying it you can cancel for a full refund, as long as the card has not been redeemed — write to us with your order reference. After redemption the piece it paid for is personalised, and section 6 applies to that piece.
8. Your legal guarantee, and our remake promise
Whatever we promise commercially, EU and Belgian law give you a two-year legal guarantee of conformity from delivery (Directive (EU) 2019/771). If the piece is faulty or does not match what we agreed, you can require free repair or replacement — and where that fails, a price reduction or your money back.
On top of that guarantee, we promise: if your piece arrives damaged or differs from the preview you approved, we make a new one free — no forms, no return postage. Email a photo of what arrived with your order reference. This promise adds to your legal rights. It never replaces them.
9. Delivery
We ship across the United States and Europe, free. Most pieces arrive within three weeks after your approval. Framed pieces and unframed prints come from different workshops, so a mixed order arrives as separate parcels, each with its own tracking link. Each parcel is our responsibility until it is delivered to you — risk passes to you on delivery.
10. The artwork and your child's likeness
The worlds, the illustration style and the finished artwork remain our property; what you buy is the physical piece. We never use your child’s likeness or your artwork for marketing or anything else beyond your order — unless you separately and explicitly say yes, and you can withdraw that yes at any time.
11. If something goes wrong
Write to [email protected] first. We confirm complaints within two working days and aim to resolve them within fourteen days. If we cannot agree, you can take the matter to an out-of-court dispute body: in Belgium, the Consumer Mediation Service (Consumentenombudsdienst / Service de médiation pour le consommateur), Boulevard du Roi Albert II 8, 1000 Brussels, consumerombudsman.be. Consumers elsewhere in the EU can use their national certified dispute bodies.
12. Liability, law, and the practical rest
We are responsible for delivering what you ordered, in good condition. Except where the law says otherwise, our liability is limited to the price you paid for the order. This limit does not apply to personal injury, or to our own intent or gross negligence. These terms are governed by Belgian law. Nothing in them takes away protections that the consumer law of your own country gives you — including, for US customers, rights under your state’s consumer laws.
The version you accepted at checkout is the one that applies to your order.
